Cogeco Cable is pleased that the Supreme Court has accepted to hear
its appeal on the compensation regime for private television stations
Montréal, September 29, 2011 Cogeco Cable Inc. (TSX: CCA) expressed its satisfaction that
the Supreme Court of Canada has accepted to hear its appeal concerning the jurisdiction of the
Canadian Radio-television and Telecommunications Commission (CRTC) to impose a
compensation regime in favour of private television stations whose signals are available free
over-the-air and redistributed via cable and satellite.
The decision comes after Cogeco Cable filed an application on April 27, 2011 for leave to
appeal a split decision by the Federal Court of Appeal rendered on February 28, 2011 ruling that
the CRTC had jurisdiction to impose such a regime under the Broadcasting Act.
It will be remembered that in March 2010, the CRTC issued Broadcasting Order CRTC 2010-
168 in which the Commission itself requested that the Federal Court of Appeal rule that it had
the necessary powers under the Broadcasting Act to implement a new compensation regime for
private local conventional television signals.
Cogeco Cable will formally file its notice of appeal with the Supreme Court of Canada shortly.
